Unconstitutional New York bills A343 and S384 would give children the right to consent to HPV and Hep B vaccines.


What is the HPV vaccine?

The HPV vaccine is a series of shots. It can prevent some types of HPV that cause cervical cancer. This cancer kills many women every year. The HPV vaccine can also help prevent genital warts in men and women.  Boys and girls as young as 9 years of age can get the HPV vaccine.

When did hepatitis B vaccine become available?The first hepatitis B vaccine became commercially available in the United States in 1982. In 1986, a hepatitis B vaccine produced by recombinant DNA technology was licensed, and a second recombinant-type hepatitis B vaccine was licensed in 1989. As a starting place, constituents are “one person with one vote.” If your position is one held by a minority, which is usually the case with vaccine freedom-of-choice advocates, legislative activism is an up-hill battle. But legislative activism involves the art of persuasion, since ultimately, legislatures can enact any law they have the votes for, Constitutional or not.
So, if you can tell your representative, “I don’t like this bill” and why that can be persuasive, but if you can add to that, “and by the way, youcan’tenact this bill into law because it’s unconstitutional,” you can substantially bolster your “one person, one vote” starting point.
Meanwhile, here’s a summary of some of the legal and other problems with NY’s A343 and S384:
1. They are unconstitutional. The U.S. Supreme Court has stated: “Most children, even in adolescence, simply are not able to make sound judgments concerning many decisions, including their need for medical care or treatment. Parents can and must make those judgments.”[1] Giving medical decision-making authority to children violates parents’ 14th Amendment Constitutional due process right to parent their children. When the state takes parental decision-making away from parents, it is essentially saying that the parents are unfit to make those decisions. When the state gives that authority to children, it is saying that kids are fit to make decisions that the parents aren’t fit to make. Rather absurd, isn’t it?!
With the above statement in BOLD FACE FONT, I agree with it completely, and yet that brings up another sore spot with me, it maybe  a little off topic but not really.  How parent’s, doctor’s  and even the Government can support a parent or a doctor who think a 13 month old child can tell what sex they are or are supposed to be just on the statement a kid makes saying I’m a girl when they are really a boy or vise versa.  Allowing treatments to said child of  hormone blocking drugs.
To me that is almost the same as saying I was born a kitten but I know I’m a duck at that young of an age and I want you to make me a Duck.  Not going to happen!   Wouldn’t the above statement apply to that too?  Shera~

This is absolutely insane!!! If children are not old enough to smoke, vote, enlist, or consent to sex, they most certainly are not old enough to consent to any type of vaccine. Additionally, it's not the government's place to encourage any citizen to get any vaccine. This is madness! That's like saying a dog has the right to consent to getting neutered.
